Judge in Delaware Reassigns Musk-Related Cases After Bias Allegations

The presiding judge of the Delaware Court of Chancery, Kathaleen McCormick, announced on March 30, 2026, that she will reassign cases involving Elon Musk. In a letter to attorneys, she said the step was prompted by what she described as the harmful effect of “disproportionate media attention” on the administration of justice.

The move followed a request from Musk’s side seeking recusal or reassignment. His attorneys pointed to McCormick having clicked a support icon on LinkedIn on a post celebrating a 2026 ruling against Musk in California. The post, written by a jury consultant, included the phrase “sorry, Elon” and congratulated the plaintiff’s law firms for “standing up for the little guy against the richest man in the world.” The motion argued that the court’s response to LinkedIn posts attacking Musk and his chosen counsel was relevant to proceedings with overlapping factual allegations and directly affected the appearance of impartiality.

McCormick said she does not support the LinkedIn post and rejected claims of bias. She stated that she either did not click the support icon at all or did so accidentally, though she said she did not believe an accidental click was likely. She also said that after reviewing the post based on a screenshot, she reported the activity to LinkedIn as suspicious. LinkedIn had not provided a comment by the time of publication.

The judge said the motion rested on a false premise and emphasized she was not biased against the defendants, noting that she dismissed a lawsuit against Musk last year. Musk’s lawyers declined to comment on the reassignment, and Musk had not commented on X, the platform he owns and frequently uses.
